Terms of Service

• Platform — the HeyFundi website, apps, and services.
• Expert ("fundi") — a user who offers skills or services and bids on jobs.
• Job Poster — a user (individual or business) who posts a job or task.
• Bid — an offer by an Expert to perform a job for a stated price.
• Expert Free / Fundi Pro — HeyFundi's free and paid expert subscription tiers.

You must be at least 18 years old and able to enter into a binding contract. By using the Platform you confirm that the information you provide is accurate and that you will keep it up to date.

You are responsible for your account, for keeping your password secure, and for all activity under your account. Tell us immediately at support@heyfundi.app if you suspect unauthorised use. We may suspend or close accounts that breach these Terms.

HeyFundi is a marketplace that connects Job Posters with Experts. We provide the venue and tools (profiles, bidding, messaging, quoting, and invoicing). We are not a party to any agreement between a Job Poster and an Expert, we do not employ Experts, and we do not perform the services ourselves.

Any contract for work is directly between the Job Poster and the Expert. They are solely responsible for agreeing scope, price, timing, quality, payment, and for complying with the law (including any licensing, tax, and insurance requirements). HeyFundi is not responsible for the acts, omissions, work quality, or conduct of any user.

We take reasonable steps to verify Experts' identity and credentials and may display verification badges. Verification is a help, not a guarantee. We do not warrant any Expert's skills, qualifications, or conduct, and you should exercise your own judgement before hiring or accepting work.

• Job Posters must describe jobs accurately and lawfully. Jobs are live for 7 days.
• Experts must bid in good faith and only for work they are competent and permitted to perform.
• A Job Poster's full contact details are shared with an Expert only after a bid is accepted.
• You must not post unlawful, misleading, infringing, or harmful content.

• Posting, bidding, and messaging are free for Job Posters.
• Experts may use Expert Free (R0) or upgrade to Fundi Pro at R129/month, which unlocks additional features (such as unlimited bids, professional PDF invoicing, featured placement, and reports).
• Free trial: Fundi Pro may be offered with a 14-day free trial. If you do not cancel before the trial ends, the subscription continues at the stated price.
• Billing: subscriptions are billed monthly in ZAR via PayFast until cancelled.
• Cancellation: you may cancel anytime; cancellation takes effect at the end of the current billing period.
• Refunds: subscription fees are non-refundable, except where a refund is required by law.
• We may change fees on reasonable prior notice.

Our invoicing and quoting tools (including a 15% VAT toggle) are provided for convenience. Experts are solely responsible for the accuracy of their invoices and for their own tax obligations, including VAT registration and SARS compliance. HeyFundi does not provide tax or financial advice.

Unless stated otherwise, payment for completed work is arranged directly between the Job Poster and the Expert. HeyFundi is not responsible for collecting, holding, or guaranteeing such payments and is not liable for non-payment or disputes about work.

You agree not to:

• use the Platform for any unlawful, fraudulent, or harmful purpose;
• post false, misleading, defamatory, or infringing content;
• circumvent fees, scrape data, or interfere with the Platform's operation;
• harass, abuse, or endanger other users; or
• misrepresent your identity, qualifications, or affiliation.

You retain ownership of content you submit, but grant HeyFundi a non-exclusive, royalty-free licence to host, display, and use it to operate and promote the Platform. Reviews must be honest and based on genuine experience. We may remove content that breaches these Terms.

The Platform, including its name, logo, design, and software, is owned by HeyFundi and protected by law. You may not copy, modify, or distribute it without our permission.

The Platform is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, including as to the quality, safety, legality, or reliability of any user, job, bid, or work performed through the Platform.

To the maximum extent permitted by law, HeyFundi will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from dealings between users. Our total liability to you for any claim is limited to the greater of R1,000 or the subscription fees you paid us in the 3 months before the claim. Nothing in these Terms excludes liability that cannot be excluded under South African law, including under the Consumer Protection Act where it applies.

You agree to indemnify HeyFundi against claims, losses, and costs arising from your use of the Platform, your content, your dealings with other users, or your breach of these Terms.

We may suspend or terminate your access if you breach these Terms or use the Platform unlawfully. You may stop using the Platform at any time. Provisions that by their nature should survive termination will do so.

These Terms are governed by the laws of the Republic of South Africa. You agree to first contact us at support@heyfundi.app to resolve any dispute. Disputes that cannot be resolved will be subject to the jurisdiction of the South African courts.

We may update these Terms from time to time. We will post the updated version and change the "Last updated" date. Continued use of the Platform after changes means you accept the updated Terms.
